Divorce is often the last step in the separation process, which is done by way of an application to the court for a divorce order. For some of our clients, a divorce is part of an on-going proceeding before the court to review and determine other related issues concerning their separation such as parenting, property division, child support and spousal supportFor others, it is the last step in a out-of-court separation that provides them with a necessary sense of closure.

 

In Canadian law, a divorce is defined as “the dissolution of a marriage”. However, in practice people use the word in family law to describe the process and steps associated with the breakdown of a marriage.

What are the criteria you must meet to get a divorce?

 

Divorcing spouses must meet certain legal criteria to obtain a Divorce Order in Ontario, including:

 

  1. There must have been a breakdown in the relationship to qualify for a divorce. You can establish this breakdown by showing that you and your spouse have been separated for at least one year.
  2. There are also residency requirements to consider, including that one party has to reside in Ontario for one year prior to the commencement of the divorce.
  3. There are also legal criteria that have to be addressed so that the court can conclude that reasonable arrangements have been made for the children by way of a previous court order or a separation agreement.
